A JUDICIAL COUP IN BRAZIL | The Country Lives Under Moraes’ Inquiry Dictatorship With No End in Sight (Op ed expanded from @jrguzzofatos) There is no good intention, never has been, and never will be, in the inquiry of two supreme justices Moraes and Toffoli. Brazil ends 2024 experiencing what is possibly the most vicious period of civil rights suppression since the AI-5 of the military dictatorship. It is also the longest and most neurotic rupture of the country’s political, moral, and cultural life from basic reality. For nearly six years, Brazil has not had a Constitution. Instead, it has a police inquiry as its supreme law—against which no one can appeal, ever. They call this democracy. The piece of paper with which the generals imposed their dictatorship on the country in 1965 essentially stated that no government act would be subject to anyone’s scrutiny, starting with the judiciary. Today’s AI-5 establishes that no act of the Supreme Federal Court (STF), especially those by Justice Alexandre de Moraes, is subject to any form of oversight, challenge, or revision. It doesn’t matter if these acts violate Brazilian laws currently in force; the STF decides what the law says, even when it says the opposite. Brazil’s current Constitution is STF Inquiry 4781—a legal depravity created on March 14, 2019, by Justice Dias Toffoli to conceal allegations of corruption against himself, and since then executed by Justice Moraes. The STF is not a police station; by law, it cannot initiate investigations. From that point on, things only got worse. The inquiry became perpetual—it has just been extended for another six months. It has no specific goal; it investigates everything. It operates under secrecy. It does not respect the right to defense or the Penal Code. At no point, since its opening, has Inquiry 4781 had anything to do with the defense of democracy. It began as a makeshift tool to censor Crusoé magazine @RevistaCrusoe , which was prohibited from publishing allegations against Toffoli. It then moved on to repress fake news, “disinformation,” anti-democratic acts, Bolsonaro’s vaccines, WhatsApp conversations, speeches in Congress, the illegal conviction of a deputy, lipstick on a statue (“flammable substance”), the Slingshot Coup, and everything under the sun. Today, it is the main working instrument of the judiciary dictatorship in Brazil. There is no good intention, never has been, and never will be, in the inquiry of Moraes and Toffoli. What exists is a spectacular exercise of hypocrisy by the left, the intellectual elites, and the political gangs controlling the National Congress to conceal a metastasizing cancer. It is a clandestinely created state of exception in Brazil, with daily oaths to the “defense of democracy” in public—and the construction of a tyranny in real life.
