U.S. Customs and Border Protection (CBP) has confirmed that Filipe Martins never entered the United States on Dec 30, 2022 — the very “fact” that Justice Alexandre de Moraes used to justify his imprisonment in Brazil.
That means a false U.S. government record was fabricated or misused to falsify evidence that Moraes relied on to imprison a former Bolsonaro advisor.
If the facts in this CBP statement are accurate, then serious federal crimes have been committed by a hose involved in knowingly fabricating or falsifying an official U.S. government record or using such falsified information to influence a Brazilian proceeding.
If someone intentionally entered a fake record into a federal database or knowingly relied on it while aware that it was false that would implicate multiple federal offenses under U.S. law.
The most direct statutes would include 18 U.S.C. § 1001, which criminalizes making false statements or using falsified records in any matter within the jurisdiction of the U.S. government. It also could trigger 18 U.S.C. § 1519, which prohibits falsifying, altering, or concealing documents with the intent to influence or obstruct the administration of justice, and 18 U.S.C. § 371, which covers conspiracy to defraud the United States. If the false record was used in an international judicial process (in this case, Brazil’s Supreme Court), it could also constitute misuse of official records.
CBP says it is investigating how this false record was inserted and used.
