“An Albanian fake asylum seeker couldn’t be deported because his son ‘doesn’t like foreign chicken nuggets.’ The ECHR must be fundamentally reformed or the Brits won't be the only ones to leave,” says Swedish MEP Charlie Weimers. Weimers referred to a case involving an Albanian migrant, Klevis Disha, who entered the UK illegally in 2001 and was convicted in 2017 after being caught with £250,000 in cash proven to be the proceeds of crime. Disha received a removal decision in August 2023 but appealed on human rights grounds, arguing that removal would breach Article 8 of the European Convention on Human Rights because of the impact on his youngest son. The child, referred to as C in court papers, suffers from complex behavioural issues, including problems with certain food textures. Judge Veloso noted that “C will not eat the type of chicken nuggets available abroad.” The judge found that forcing C either to move to Albania or to remain in Britain without his father would cause “severe and traumatic loss.” Both scenarios were deemed “unduly harsh,” and Disha was therefore allowed to remain in the UK.
